U.S. – Washington Department of Ecology Amends Reporting Rule of the Children’s Safe Products Act

On September 29, 2017, the State of Washington Department of Ecology adopted amendments to the Children’s Safe Products Reporting Rule, chapter 173-334 of the Washington Administrative Code. This amendment removed the phased-in reporting requirement and made reporting an annual requirement, making it consistent with other states that require reporting for certain chemicals in children’s products. Additionally, the amendment also revised the Chemicals of High Concern to Children (CHCC) list.
Following is a summary of key revisions:
- The annual reporting date set to January 31, 2019, and annually thereafter
- Reports submitted on January 31, 2019, apply to children's products sold or offered for sale in Washington between September 1, 2017, and December 31, 2018
- Reports submitted on January 31, 2020, and annually thereafter, apply to children's products sold or offered for sale during the prior calendar year
- Added definitions for the terms “De minimis level” and “Internal component” in the rule
- Clarified that the previous year’s report may be copied and submitted, if no change in the reported information has occurred in the past year
- Clarified that CHCC reporting is based on total concentration
- Revised the CHCC list: 22 CHCCs were added and 3 CHCCs were removed
- Removed reporting for phthalic anhydride (85-44-9), Octamethylcyclotetrasiloxa ne (D4) (556-67-2) and Molybdenum & molybdenum components (7439-98-7)
- Splits the Nonylphenol listing to 3 individual listings of 4-Nonylphenol (104-40-5), Nonyl phenol (25154-52-3) and 4-Nonyl phenol branched (84852-15-3)
- Added 20 chemicals to the CHCC list, highlighted in bold text in the CHCC list below
