Your India REACH Superhero: The Authorized Representative

How Intertek can support you and your supply chain in navigating India REACH
The European Union (EU) Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regulation has served as inspiration for multiple countries worldwide since its introduction in 2007. If you are selling your products in India, you have certainly heard whispers of the implementation of yet another REACH regulation, and with the draft India Chemicals (Management and Safety) Rules expected to come into force by the end of 2022, it's time to start thinking about your business' plans.
As the implementation date of India REACH grows closer, you may be wondering how this impacts you, as a foreign manufacturer, formulator, or trader. If you have experience with EU REACH, then you know that the legal responsibility of REACH registration lies with the EU manufacturers and importers. The same is true of India REACH.
It may seem easiest to leave it to your Indian customers to manage compliance. However, India REACH will require your Indian customers to know the full composition of each of the finished mixtures they are importing. This means that you, as their foreign supplier, will be required to disclose your confidential product compositions to your Indian customers—this could have catastrophic consequences for your business! What's more, leaving this responsibility to your Indian customers could result in losing them to other suppliers who are willing to provide them with REACH coverage.
Your Hero: The Authorized Representative!
At this point, the idea of expanding your business in India may have you feeling stressed out. Fortunately, there are experts ready to come to the rescue: You can appoint an Authorized Representative (AR) in India, which will absolve your Indian customers of their regulatory requirements, allowing you to keep your secret product compositions confidential.
