The Safe Drinking Water and Toxic Enforcement Act, 1986 (also known as Proposition 65) is a California law that has been in effect since 1986 to promote clean drinking water and keep toxic substances that cause cancer and birth defects out of consumer products.
“No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individual.” - California Proposition 65, The Safe Drinking Water and Toxic Enforcement Act, 1986
Companies are becoming increasingly vulnerable to lawsuits for Proposition 65 indiscretions. According to the 2012 California Proposition 65 Enforcement Report, there were 437 settlements, with a total cost of $22.5 million in 2012.
