The Eurasian Economic Union (EAEU) Council, which is comprised of the five member states (Russia, Belarus, Kazakhstan, Armenia and Kyrgyzstan) approved the “Technical Regulation of Eurasian Economic Union on Safety of Chemical Products - TR EAEU 041/2017” (also referred to as Eurasia REACH) on 3rd March 2017. The decision of the Eurasian Commission No. 19 regarding the TR EAEU 041/2017 was published on 18 May 2017.
The Technical Regulation on Safety of Chemical Products (TR EAEU 041/2017) is expected to come into force on 30 November 2022. The TR EAEU 041/2017 establishes mandatory requirements for any chemical substance(s), mixture, or other chemical product intended to be placed on the market in EAEU states (i.e., requirements for the safety of chemical products, conformity assessments, product identification and labeling, and terminology).
Eurasia REACH covers all types of chemical substance(s) except those listed in Annex I of the regulation. In addition, other annexes contain information on permissible deviations in the content of hazardous chemicals in products, the structure of the chemical safety report, the maximum content of restricted substances in products, and the application form for the state registration of chemical products.
Eurasia REACH will require companies to submit registrations of their chemical substance(s) to a member state authority within the EAEU. The type of registration will vary depending on the whether the chemical is new or existing. Existing substances will receive an individual registration number and new substances will require an additional notification procedure.
Chemical Inventory Listing
The governing authorities within the EAEU are currently compiling the final Inventory of Existing Substances. Companies need to ensure that their chemicals are listed in the inventory. The deadline to finalize the inventory in Russia was 01 August 2020. A preliminary list of 50,000 substances is already available. The final results of the inventory of chemicals in the Russian Federation was made available as of 30 December 2020.
For Foreign Businesses
Foreign companies located outside of the EAEU intending to place their chemical substance(s) on the EAEU market may submit their existing chemical substances to the Inventory and register later via a ‘Authorized Person’.
